SubscriberWise, the nation’s leading provider of analytics-driven subscriber risk management announced today that it has obtained official notice of acceptance and acknowledgment of Declaration of Use and Incontestability from the United States Patent and Trademark Office under Sections 8 and 15 of the Trademark Act (15 U.S.C. § 1058 & 1065).
Among the statutory requirements, the acknowledgment of Incontestability can only be obtained once the mark has been in continuous use in commerce for a period of five (5) years after the date of registration, or date of publication under § 12(c), and the mark is still in use in commerce.
“This declaration of incontestability provides an extra layer of important protections and advantages to the SubscriberWise mark and brand,” said David Howe, president of SubscriberWise. “Our trademark is a valuable and permanent part of our intellectual property. It’s become a highly respected mark that is well known and instantly recognized by cable and telecom operators everywhere. Protecting this property from improper use, challenges, or infringement benefits not only our member operators - and the millions of customers they serve - but also our owners, cooperative associations, and technology partners around this country and the world.”
“MCTV owns a minority stake in SubscriberWise,” said Robert Gessner, MCTV president and current vice chairman of the American Cable Association. “The technology and domain expertise evolved here during the past 10 years. It’s gratifying to know that the USPTO has acknowledged this statutory declaration for this trusted brand. It’s even more gratifying to understand first-hand the tremendous benefit SubscriberWise delivers to MCTV’s bottom line every day.”
MCTV is the new name for Massillon Cable TV and Clear Picture (http://mctvohio.com).
